This page applies to TakeYup!'s global edition. Any comparisons with the China edition are retained as background; China-only descriptions do not apply to this app.

These apps are provided by Guangzhou Kuke Internet Information Technology Co., Ltd ("KuKe", "we"). By downloading, installing or using our apps, you agree to these terms.

1. Software licence

Our apps are licensed under Apple's Standard End User Licence Agreement:

https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

2. TakeYup! (iOS)

This section (2 to 2.7) sets out terms specific to TakeYup! and applies together with the rest of these terms. TakeYup!'s personal-habit features need no account. Teams, the Plaza and the Inbox need you to sign in, and to sign in you tick a box agreeing to these terms and the Privacy Policy. TakeYup! comes as two separate apps, a China edition and a global edition, whose accounts and data are entirely separate. How we handle your personal information is described in the Privacy Policy.

2.1 Membership, trial and subscription

Free plan

  • Creating and managing habits, and setting frequencies, targets, check-in windows and reminders
  • Photo, pose, meal and press-and-hold check-ins, stats and awards
  • Teams, the Plaza and the Inbox
  • Your earliest 3 habits by creation date can be checked in (team habits count towards the 3); other habits stay in your list and can be checked in again once you become a member
  • The Clean theme and default background; stars and stickers stop accumulating, and every star and sticker you already have is kept

Membership

  • Unlimited habits
  • Stars and stickers: earn stars by checking in and trade them for stickers; gifting stars and redeeming stickers in teams also need membership
  • The Journal theme and custom background images

The 5-day free trial

  • Counted as 5 calendar days from the day you first launch the app, with every membership benefit included
  • The trial needs no subscription, charges nothing when it ends, and does not restart if you delete and reinstall the app
  • When you create an account, our server also records a 5-day trial for that account (counted from the day it is created), used to decide membership features in teams, such as check-in slots on team habits and gifting stars
  • If the trial ends without a subscription, you move to the free plan and the theme and background return to the Clean theme and default background; subscribing brings your previous choices back

Subscription

  • Billing period: monthly, quarterly or yearly — your choice
  • Price: as displayed in your local App Store
  • Auto-renewal: renews within 24 hours before the end of the current period unless you cancel first
  • To cancel: turn off auto-renewal in your Apple ID account settings; you keep access for the remainder of the paid period
  • TakeYup! does not offer a one-time lifetime purchase

2.2 Your account

  • Signing up and signing in — In the China edition you sign in with a mainland China phone number; in the global edition, with Apple or X. Your account is created the first time you sign in. You can link several sign-in methods to your account, but at least one must remain. Each phone number or third-party account can belong to only one TakeYup! account, and we never merge two accounts automatically.
  • Age — If you are under 14 (or another age set by the law where you live), you should create and use an account and team features only with the consent and guidance of a parent or guardian.
  • Keeping your account safe — Keep your device and sign-in methods safe; activity under your account is treated as yours. Your account is for you alone and may not be lent, transferred or sold. If you think someone else is using it, contact us promptly.
  • Profile — Your nickname, avatar and other profile details must be lawful and genuine, must not impersonate any person or organisation, and are reviewed (see 2.5).

2.3 Teams and the Squad Guidelines

Teams are for keeping up habits together. By creating or joining a team, you agree to follow the in-app Squad Guidelines and the rules in this section:

Squad Guidelines

  • Do: cheer each other on, share tips, and celebrate streaks
  • Do: keep the conversation focused on your habit goals
  • Don't: share personal secrets, private contact information or off-topic content
  • Never: post insulting, violent, sexual or other harmful content, or anything else the law prohibits (such as unlawful material, content that infringes others' rights, advertising and spam)

Team leaders

  • Whoever creates a team is its only leader, responsible for the team profile, team habits and their shared reference photos, how people join, the member limit and automatic removal of inactive members; the leader can remove members, reset invite codes and disband the team
  • A leader can hand leadership to a member; the handover takes effect once that member accepts within 7 days
  • When a leader leaves the team or deletes their account, the system automatically picks a successor from the other members by the number of active days in the last 30 days and by how long they have been in the team (members who are suspended, muted or otherwise ineligible are skipped). If no member can take over, a leader must disband the team before leaving, and deleting the leader's account disbands it automatically
  • When a team is disbanded, its team habits become personal habits on members' devices, and existing check-ins are kept
  • A leader's powers extend only to their own team, and leaders must follow these terms when running it

Joining and taking part

  • You can join a team from the Plaza, with an invite code or with a QR code. Where a team requires approval, any member can approve you; a request not handled within 7 days lapses
  • How many teams each person can create and join, and the member limit of each team, are as shown in the app
  • If the leader turns on "Remove inactive members", members with no check-ins or interactions for the chosen period are removed, with a reminder 3 days beforehand
  • Personal reference photo requests need teammates to vote in favour and lapse if not approved within 24 hours

Fair check-ins

  • Check-ins on team habits must be genuine. Do not fake them with photos of screens, other people's photos or similar means, and do not use multiple accounts or other tricks to manipulate leaderboards, stars or votes
  • Check-ins submitted more than 72 hours after the fact do not count towards team progress or the leaderboard
  • Leaderboards are calculated by our server under published rules (70% completion, 30% number of check-ins). Where we find a calculation error or cheating, we may correct scores and take the other measures in these terms
  • Stars and stickers can only be used in the app, have no cash value and cannot be exchanged for money

2.4 Content you submit

  • Ownership — Nicknames, avatars, team profiles, team habit names and reference photos, personal reference photo requests, posts, comments and other content you submit in TakeYup! remain yours or their original owner's.
  • The licence you give us — So that we can provide the service to you and to the people you choose, you give us a non-exclusive, royalty-free licence to store, copy and process that content (for example compressing images and removing metadata), to review it, and to show it to the audience you choose (your teammates, or the Plaza), only as far as running TakeYup! requires. We do not use your content for advertising or sell it. The licence ends when you delete the content or your account, except for review records we must keep by law.
  • Your promise — You have the right to submit the content, and it does not infringe anyone else's copyright, image rights, privacy or other rights. Before uploading a photo showing another person or their personal information, get their consent.
  • Who sees it — Content inside a team is visible only to that team's members; a team shown in the Plaza has a public summary other users can see. See section 2.5 of the Privacy Policy.

2.5 Moderation and enforcement

  • Review — Everything others will see is reviewed: in the China edition by our moderators; in the global edition first by automated moderation services and, where needed, by our moderators. The preset avatars and team icons built into the app need no review. Automated review can make mistakes, and you can appeal a result (see 2.6).
  • Content that fails review — If content fails review or is later found to break the rules, we take that version down. If an earlier approved version exists, that version is shown again; if not, a "hidden version" is shown instead, with placeholder names such as "User", "Team" or "Habit" and a placeholder image. A hidden team habit pauses check-ins until a new standard submitted by the leader passes review; check-ins made before it was hidden still count.
  • Takedown notices — If a team name, team habit name or shared reference photo is found to break the rules, members who received it get a takedown notice, and the app replaces the offending name stored on their device and deletes the offending shared reference photos. Check-ins are not affected.
  • Penalties — Depending on how serious a breach is, we may take one or more of the following measures against an account, temporarily or permanently: Muted (you cannot publish or edit content); Content hidden (your nickname, avatar, posts, comments, personal reference photo requests and cheers are no longer shown to others, while the team profile and team habits you publish as a leader are unaffected); Suspended (the account and online features stop working; personal habits on your device are unaffected). Where necessary we may also delete a team that breaks the rules.
  • Re-review — We may re-review an earlier decision at any time and change it; if content is approved on re-review, it is restored.

2.6 Reporting, blocking and appeals

  • Reporting — You can report users, teams, team habits, posts, comments and personal reference photo requests; reporting requires signing in. We never tell the reported person who reported them. You will hear about progress in your Inbox; a report being submitted does not mean the content necessarily breaks the rules.
  • Blocking — You can block other users and unblock them at any time under Account → Blocked. Once you block someone, neither of you can see the other's avatar, nickname, posts, comments or leaderboard entry, neither of you receives messages triggered by the other, and they cannot join a team you lead.
  • Appeals — If your content fails review or your account is penalised, you can appeal from the related Inbox message and give your reasons. Each decision can be appealed once; we will review it and tell you the outcome.
  • Feedback — You can send comments and questions about TakeYup! from Feedback in the app, even without signing in, or email us.

2.7 Deleting your account

You can delete your account in the app at any time, and deletion cannot be undone: you leave every team (teams you lead pass to another member or are disbanded), your nickname and avatar are anonymised, and your posts, comments and cheers are taken down. Records that involve others and records we must keep by law are retained. Signing in later with the same phone number or third-party account gives you a brand-new account. Deleting your account does not cancel an App Store subscription; to cancel, use your Apple ID account settings. See section 2.10 of the Privacy Policy.

4. Refunds

All payments and refunds are handled by Apple. KuKe cannot issue refunds directly — please file a request through Apple's "Report a Problem" page.

5. Acceptable use

You agree not to reverse-engineer or crack our apps, not to circumvent subscription checks or check-in validation by any means, and not to use them for any unlawful purpose. When using TakeYup!'s accounts and team features, you also agree not to register accounts in bulk, not to use anyone else's phone number or identity, not to send spam or harass others, and not to scrape data or interfere with our servers by automated means. We reserve the right to restrict features where we find abnormal use.

6. Limitation of liability

Our apps are built to improve working and living habits. They are not medical devices and offer no medical, health or psychological diagnosis or advice. KuKe is not liable for health or vision problems arising from computer or phone use, nor for anything you miss by relying on in-app reminders. TakeYup!'s photo recognition is based on a machine-learning model and can get things wrong; its results are not proof of what you actually did. Content posted by other TakeYup! users is their own responsibility; we deal with content that breaks these terms, but cannot guarantee to catch all of it promptly. Online features may be temporarily unavailable because of maintenance, network problems or failures of third-party services; personal-habit features are unaffected.

7. Changes to these terms

We may update these terms from time to time; material changes will be reflected in the date at the top of this page. Continuing to use the apps after a change means you accept the updated terms.

8. Governing law

These terms are governed by the laws of the People's Republic of China. Any disputes shall be submitted to the People's Court of Baiyun District, Guangzhou.
